Terms of Service

This is a working draft. Before going live, have it reviewed by counsel familiar with your jurisdiction. The terms below set our starting expectations but should not be relied on as legal advice.
These Terms (“Terms”) govern your use of the Family Business Performance Group platform (the “Service”), provided by Family Business Performance Group (“we,” “us”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
1. Accounts
You must be at least 18 years old. You're responsible for keeping your password secure. Notify us immediately at security@familybusinessperformance.group if you suspect unauthorized access. You can revoke all your sessions at any time at /account.
2. Acceptable use
You agree not to:
- Reverse engineer, scrape, or attempt to gain unauthorized access.
- Use the Service to send spam or unlawful content.
- Impersonate another person or organization.
- Upload malware or exploit security vulnerabilities (responsible disclosure is welcome — see our security contact).
- Resell or redistribute the Service.
3. Coaching content
The Service is a coaching and consulting platform for family businesses. Information we provide — including AI-generated briefs — is informational and is not legal, financial, tax, or psychological advice. Decisions you make based on it are your own. For regulated decisions, consult a licensed professional.
4. AI features
We use Anthropic's Claude API to generate diagnostic briefs and related summaries. AI output may contain errors, omissions, or biases. You are responsible for reviewing AI output before relying on it. Your data is processed under Anthropic's terms; we do not authorize training on your data.
5. Your content
You own the data you put into the Service (business records, family information, notes, messages, assessment responses, etc.). You grant us a limited license to host, process, transmit, and back up that content as needed to provide the Service. We do not claim ownership and we don't sell your data.
6. Confidentiality
Coaches and clients on the Service often share confidential business information. The Service's authorization model restricts each client's data to that client and the coaching team — see our Privacy Policy and SECURITY.md for the technical posture. You agree to use the Service's authorization features (roles, sign-out everywhere, etc.) to protect confidential information.
7. Service availability
We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance and outages can occur. We are not liable for downtime, data loss, or third-party vendor disruptions. For status updates, email support@familybusinessperformance.group.
8. Termination
Either of us can end the engagement at any time. If we terminate your access for cause (e.g. violation of these Terms), we'll explain why. On termination, your data is retained per the Privacy Policy and then deleted.
9. Disclaimers
The Service is provided “as is” without warranties of any kind, express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent allowed by law.
10. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months prior to the claim, or USD $100 if you have not paid us. We are not liable for indirect, consequential, or special damages.
11. Changes
We may update these Terms occasionally. If changes are material, we'll notify active accounts by email and post the change here with a new “last updated” date. Continued use after the change constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the state in which Family Business Performance Group is registered, without regard to conflict-of-law rules.
